I learned this:

In the UK – not sure about elsewhere – if I submit an article to a newspaper and get paid I can then, re-use the same article, with minimal alteration, and sell it to another newspaper or magazine.

This is kinda similar, I think. If you take the same ingredients, i.e OTR, and rearrange the words then it should surely be classed as a new work, or, “work”

There are only so many words we can use so the words in OTR are bound to be reused.

The only grey area I can see is in the use of names. Sal Paradise, Dean Moriarty et al, would still be the same through a cut up.
